Terms and Conditions

Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

  • Cooling-off period: The time frame in which the consumer may exercise their right of withdrawal.

  • Consumer: Any natural person not acting on behalf of a business or profession, who enters into a distance agreement with the entrepreneur.

  • Day: A calendar day.

  • Continuous transaction: An agreement for recurring supply of products and/or services, where obligations extend over time.

  • Durable medium: Any tool that allows consumer or entrepreneur to store information in a way that enables future reference and unchanged reproduction.

  • Right of withdrawal: The option for the consumer to cancel the distance contract within the cooling-off period.

  • Entrepreneur: AXIIN ENTERPRISE, trading as HerEterna, who offers products and/or services remotely to consumers.

  • Distance contract: An agreement made as part of a structured system for remote sales, using one or more forms of distance communication until the contract is concluded.

  • Remote communication technique: Any method used to conclude an agreement without consumer and entrepreneur being in the same location.

  • General Terms and Conditions: These conditions as set forth by HerEterna.

Article 3 – Scope of Application

  1. These Terms and Conditions apply to every offer made by HerEterna, and to every distance contract concluded between HerEterna and the consumer.

  2. Before entering into a contract, the text of these Terms and Conditions will be provided to the consumer. If this is not reasonably possible, HerEterna will indicate how the Terms can be reviewed electronically, and a free copy will be sent upon request.

  3. If the contract is concluded electronically, these Terms may also be provided in digital form, in a way that allows storage on a durable medium.

  4. If product-specific or service-specific conditions apply in addition to these Terms, the consumer may rely on the provision most favorable to them in the event of conflict.

  5. Should any provision of these Terms prove invalid, the remainder will continue to apply, and the invalid clause will be replaced with one that reflects the intended meaning as closely as possible.

  6. Any situations not explicitly covered will be interpreted in the spirit of these Terms.


Article 4 – The Offer

  1. If an offer is subject to limited availability or conditions, this will be clearly stated.

  2. All offers are non-binding and may be revised by HerEterna.

  3. The offer includes a complete and accurate description of the product, in this case our Women’s Probiotic Gummies. Product images are intended as truthful representations, but actual colors may differ slightly.

  4. Obvious errors or mistakes in the offer do not bind HerEterna.

  5. Each offer clearly sets out the consumer’s rights and obligations, including but not limited to:

    • The product price (exclusive of import duties, VAT, or applicable taxes, unless otherwise stated).

    • Any shipping costs.

    • The method of forming the contract.

    • The right of withdrawal, if applicable.

    • Accepted payment methods and delivery details.

    • The time period for accepting the offer.

    • The minimum duration of any continuous transaction, if applicable.


Article 5 – The Contract

  1. A contract is concluded once the consumer accepts the offer and meets the required conditions.

  2. If acceptance is made electronically, HerEterna will confirm receipt promptly via email. Until confirmation is received, the consumer may cancel the order.

  3. HerEterna ensures a secure environment for electronic transactions.

  4. HerEterna reserves the right, within legal limits, to assess whether a consumer can meet payment obligations. Orders may be refused or subject to conditions if reasonable grounds exist.

  5. Upon completion of the contract, HerEterna will provide the consumer with:

    • The business address for complaints.

    • Instructions on the right of withdrawal (or information if it does not apply).

    • Details of after-sales services or warranties.

    • The main terms of the order.


Article 6 – Right of Withdrawal

  1. Consumers have the right to cancel their purchase within 14 days of receiving the product, without providing a reason.

  2. During this period, the consumer must handle the product and packaging with care. The product may only be used to the extent necessary to determine if it meets expectations.

  3. To exercise the right of withdrawal, the consumer must notify HerEterna in writing (e.g., via email to info@hereterna.com) within 14 days of receipt. The product must then be returned within 14 days of notification, in its original condition and packaging.

  4. Proof of return, such as a shipping receipt, must be retained by the consumer.

  5. If the consumer does not comply with the withdrawal timelines, the purchase will be considered final.

If the consumer does not notify withdrawal within the timeframes mentioned in paragraphs 2 and 3 or does not return the product, the purchase is final.
